1. Overview

These Terms of Service (“Terms”) govern your use of the Quirk Cycles website and the purchase of products from us.

The terms “we”, “us” and “our” refer to Quirk Cycles Ltd. Our store is hosted by Shopify Inc., which provides the ecommerce platform that enables us to sell our products to you.

By accessing our website or placing an order, you agree to be bound by these Terms and our Privacy Policy.

3. Made-to-Order Products (Important)

Quirk Cycles manufactures frames and complete bicycles in scheduled production batches.

When you place an order for a frame or bicycle:

  • You are purchasing a made-to-order product.

  • Your order secures a place in a scheduled production run.

  • Materials and workshop time are allocated specifically for your build.

Under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013, the statutory 14-day cooling-off period does not apply to goods made to the consumer’s specification or clearly personalised goods.

We offer a 48-hour cancellation window from order confirmation as a goodwill period. After 48 hours, orders for made-to-order products cannot be cancelled, except where required by law.

Nothing in this clause affects your rights in relation to faulty or misdescribed goods under the Consumer Rights Act 2015.

 


 

4. Orders & Acceptance

When you place an order, you are making an offer to purchase.

Your order is accepted when we send you a confirmation email and payment has been successfully processed.

We reserve the right to decline or cancel an order before acceptance for reasons including pricing errors, availability issues, or suspected fraud.

 


 

5. Payment

All products must be paid for in full at the time of purchase.

Prices are shown in GBP unless otherwise stated and exclude delivery, taxes, duties or import charges unless specified.

You are responsible for providing accurate billing and payment information.

 


 

6. Lead Times & Production

Any stated lead times are estimates only and are not guaranteed delivery dates.

Delays may occur due to:

  • Supplier availability

  • Component shortages

  • Paint or finishing processes

  • Events beyond our reasonable control

We shall not be liable for indirect or consequential losses resulting from delays.

 


 

7. Delivery & Risk

Delivery times are estimates only.

Risk passes to you when the goods are delivered to you (or a person nominated by you).

You must inspect goods upon delivery and notify us within 48 hours of any transit damage.

Ownership of goods passes once full payment has been received.

 


 

8. Returns & Cancellation

Returns and cancellations are governed by our separate Returns Policy.

In summary:

  • Made-to-order frames and bicycles cannot be cancelled after 48 hours from order confirmation.

  • The statutory 14-day cancellation right does not apply to made-to-order products.

  • Accessories and non-custom items may be returned in accordance with our Returns Policy.

 


 

9. Sizing & Specification Responsibility

Customers are responsible for confirming correct size and specification before placing an order.

We provide guidance where requested, but final responsibility rests with the customer.

Incorrect size selection does not constitute a defect.

 


 

10. Warranty

Our products are covered by a limited warranty as set out in our separate Warranty Policy.

This is in addition to your statutory rights.

 


 

11. Intellectual Property

All content on this website, including designs, images, text, branding and product designs, remains the property of Quirk Cycles Ltd.

No content may be reproduced without written permission.

 


 

12. Limitation of Liability

Nothing in these Terms limits or excludes liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot be excluded under UK law

Subject to the above, our total liability arising out of or in connection with any product shall not exceed the purchase price paid for that product.

We shall not be liable for indirect, incidental or consequential losses.

 


 

13. Disclaimer

To the fullest extent permitted by law, products are supplied as described on our website.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

 


 

14. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms from time to time. The latest version will always be available on our website.
